In a Quick and Sharp Judgement..this 3 member bench supervened the SLOGAN BASED silly judgement of a 2 member bench ! Very Righteously !!!
There is no such thing as Judicial Activism
Constitutionally Judiciary has the assigned domains..and BY GITA as well as by Legal Tradition..these Jurisdiction must be exercised..and never be not exercised when asked for..even needed ! In Gita this is said as Karmanyeva Adhkaraste..and..ma te..akarmani..in the same Famous Verse !
To transgress these limits OR to not exercise jurisdiction are both Activism/Passivism..to misuse/abuse is misbehaviour in the least and can extend upto CRIMINALITY..to not know these is incapacity..TO SIMPLY HOWL is..you name it..
At this juncture this is pertinent to note that after the Matherchod Js Chapp Chati Kukerji and Sar kab tak Hilaya Sanpak did their kutta mutti on the Case of Rights..a petition challanging this judgement under Art 32 and 13 was filed..showing that they have transgressed judgements of 5 member bench ! This was dumped by a Registrar..a puupy of the bull dogs ? This is the colour of SCI..who are custodians of Rights ! Do you note this CJI K G Balakrishnan..later many members of my family will perish but Js Nangesh Kuttar Muttanwal and Santosh N HeGadhe won't see the Sun in front of their blinded eyes !
